This policy establishes the legal boundaries of our services to protect both the client and the Notary Public. Please review these guidelines prior to booking an appointment.
↪ General Notary Authority & LimitationsClearMarkSC provides mobile notarization services under the commission of the State of South Carolina. As a Notary Public, I am an impartial state-commissioned witness authorized to perform acknowledgments, administer oaths and affirmations, take attestations and jurats, witness signatures, verify facts, and perform other notarial acts authorized by South Carolina law.No Legal Advice (UPL): I am not an attorney. By law, I cannot draft legal documents, explain the legal effects of a document, provide guidance on how to complete a document, or select the type of notarial certificate required.Document Completion: All documents must be fully completed before the notarization takes place. If unsure whether a field may remain blank, contact the document provider or a licensed attorney before scheduling. I am legally prohibited from notarizing a signature on a blank or incomplete document. Do not sign before the appointment unless the document provider or receiving agency has instructed you that prior signing is acceptable. Many documents requiring a jurat, affidavit, or signature witnessing must be signed in the Notary's physical presence. If unsure, leave signature lines unsigned until the appointmentNotarial Act Selection: The signer, document provider, attorney, or receiving agency must identify the required notarial act. ClearMarkSC cannot choose the notarial act, select certificate wording, or advise which notarization is legally appropriate.

↪ Fees & Travel
Current notarial fees, mobile service fees, and travel-fee information are listed under Services. All fees are confirmed before travel. Notarial fees are separate from any travel or mobile service fee. Any travel fee must be agreed upon in advance and is neither specified nor mandated by South Carolina law.

↪ Payment & Appointment Readiness: Payment is due at the appointment unless otherwise agreed in advance. The client is responsible for signer presence, acceptable identification, completed documents, required witnesses, and access to the appointment location. If the appointment cannot proceed because these requirements are not met, any agreed travel, waiting, cancellation, or no-show fee may still apply. Notarial fees apply only to notarial acts performed.

ClearMarkSC may perform lawful notarial acts for properly prepared documents when all requirements are met. South Carolina real-estate closings are legal matters and are handled through the appropriate attorney-directed process. ClearMarkSC does not independently conduct real-estate closings, select closing documents, explain loan or title documents, or provide legal advice.For document-specific requirements, contact the attorney, title company, lender, or recording office that provided the document.

↪ Copy Certification: South Carolina notaries may not certify or authenticate photographs or photocopies. ClearMarkSC does not issue certified copies. If a receiving agency accepts a document holder's sworn statement about a copy, ClearMarkSC may administer the oath or affirmation and complete the appropriate notarial certificate; the document holder remains responsible for the statement.

↪ Witness Requirements
South Carolina law frequently requires independent witnesses for specific legal documents, such as deeds and mortgages, to be properly recorded (S.C. Code Ann. § 27-7-10).Client Responsibility: Clients must provide their own independent, impartial, and competent witnesses of legal age.Notary Exclusion: To maintain strict impartiality and avoid any conflict of interest, the acting Notary Public will not serve as a dual witness on any document being notarized.
